Last Will and Testament of JAMES HEASTINGS

26 April 1848

In the name of God, amen. I, James Heastings, of the township of Whitchurch, province of Canada and county of York, do make this my last will and testament in manner and form following, that is to say:

Firstly, after payment of all my just debts, funeral and testamentary expenses, I give, devise and bequeath unto my oldest son, Thomas Heastings, the sum of five shillings to be paid six months after my death.

Secondly, I give, devise and bequeath unto my second son, Adam Heastings, the west half of lot no. twelve in the sixth concession of the township of Whitchurch, by his paying fifty pounds to each of my two daughters, Sarah Davison and Mary Ann Heastings. My oldest daughter, Sarah, is to receive twenty-five pounds two years after my death, my second daughter, Mary Ann Heastings, to receive twenty-five pounds four years after my death. Then Sarah is to get her second twenty-five pounds six years after my death and Mary Ann in eight years after my death.

Lastly, I give unto my beloved wife, Ginet, all of my loose property in the house and out in the country on my farm as long as she lives, but my son, Adam, is to have one cow and a team of horses.

Lastly, I do appoint James Heastings, John Macklim and my beloved wife, my lawful Executors in revoking all other wills by me made.

Signed in the presence of us, this twenty-sixth day of April in the year of our Lord one thousand eight hundred and forty-eight.

Appraisal of the property of James Heastings:

 

UNTO THE SURROGATE COURT
The United Counties of York and Peel

The Petition of Ginet Heastings of the Township of Whitchurch in the County of York, widow.

Humbly sheweth:

That James Heastings, late of the Township of Whitchurch in the County of York, Yeoman deceased, died on or about the first day of February in the year of our Lord one thousand eight hundred and fifty six at Whitchurch in the County of York and that the said deceased at the time of his death had his fixed place of abode at the Township of Whitchurch in the said County of York. That the said deceased in his life time duly made his last Will and Testament, bearing date the twenty sixth day of April in the year of our Lord one thousand eight hundred and forty eight.

That your Petitioner is the executrix named in the said Will. That the value of the personal estate and effects of the said deceased which he in any way died possessed of or entitled to, and for and in respect to which a probate of the said Will is to be granted are of or about the value of seven hundred and fifty dollars, to the best of your Petitioner's knowledge and belief.

WHEREFORE your Petitioner prays that probate of the said Will of the said deceased may be granted to her by this homourable Court. Reserving unto James Heastings, one of the executors, power to prove the same hereafter.
